| Abstract | Tato diplomová práce je zaměřena na oblasti sociálního dialogu, pracovního práva a především kolektivních smluv a jejich specifik v kontextu divadelního prostředí. Práce si dává za cíl strukturovaně popsat smysl sociálního dialogu a jeho úlohu při vyjednávání především na podnikové úrovni zaměstnanec – zaměstnavatel a nabízí možnou podobu jednoho z hlavních výstupů tohoto dialogu – kolektivní smlouvy. Výstupem práce jsou odpovědi na otázky: Jak vzniká sociální dialog a jaké jsou jeho možné výstupy? V čem spočívají výhody kolektivních smluv oproti jiným výstupům sociálního dialogu? Jaká práva a požadavky se mohou uplatňovat v kolektivních smlouvách? A jaká jsou specifika, výhody a nevýhody kolektivních smluv ve v netypickém pracovním provozu – divadle? Práce je členěna do čtyř částí a snaží se problematiku popsat od pojmu sociální dialog přes legislativu spjatou s kolektivními smlouvami a strany, které kolektivní smlouvy projednávají a uzavírají až po konkrétní obsah těchto smluv a jeho možnou podobu. Závěr práce nabízí shrnutí výzkumných poznatků a krátký komentář současného stavu legislativy spjaté se zkoumanou problematikou. |
| Translation of abstract | This diploma thesis is focused on the areas of social dialogue, labor law, and especially collective agreements and their specifics in the context of the theatrical environment. The thesis aims to describe in a structured way the meaning of social dialogue and its role in negotiations, especially at the company level, employee-employer and offers a possible form of one of the main outputs of this dialogue - the collective agreement. The output of the work are answers to the questions: How does social dialogue arise and what are its possible outcomes? What are the advantages of collective agreements over other outputs of social dialogue? What rights and requirements can be applied in collective agreements? And what are the specifics, advantages, and disadvantages of collective agreements in the context of an atypical working environment - theater? The work is divided into four parts and tries to describe the issue from the concept of social dialogue through legislation related to collective agreements and parties that discuss and conclude collective agreements to the specific content of these agreements and their possible form. The conclusion of the thesis offers a summary of the research findings and a brief commentary on the current state of legislation related to the issues examined. |
