| Abstract | Problematika výkonu kolektivní správy představuje v současné době jedno z nejdiskutovanějších témat v prostředí českého dabingu. V této oblasti působí několik profesí, přičemž nejčastěji je toto téma podrobováno kritické diskuzi ve vztahu k dabingovým hercům, a to zejména s ohledem na jejich možnosti obrany vůči činnosti a postupům kolektivního správce. Přestože se jedná o důležité a aktuální téma, není mu v odborné literatuře věnována přílišná pozornost. Tato bakalářská práce si proto klade za cíl věnovat se institutu stížnosti dle § 101g autorského zákona, který představuje de facto jediný právní prostředek, kterým dabingový herec disponuje vůči kolektivnímu správci. Je proto žádoucí podrobit tuto oblast a zejména její právní úpravu kritické analýze. Hlavním přínosem této práce by proto mělo být nejen přispění do odborné diskuze, ale i formulace úvah de lege ferenda. |
| Translation of abstract | The issue of executing a collective administration is one of the most discussed topics of the Czech dubbing environment. There are several professions in this area and this topic is a subject to a critical discussion especially in regards to dubbing actors and their possibilities of defense against the actions and approach mechanisms of the collective administration. Even though it’s an important and current topic, it has not been granted enough attention in specialized literature. This bachelors thesis would therefore like to address this issue according to § 101g of the Copyright Act, which is for a dubbing actor somewhat of a means of defense against his collective administration. It is therefore highly desirable to subject this area and especially legislation to a critical discussion. The main benefit of this thesis should therefore be not only a contribution to the discussion on the topic, but also its help forming of the considerations de lege ferenda. |
