| Abstract | Tato práce se věnuje historickému vývoji autorského práva ve fotografii do roku 1948 a jejím cílem je hledání konkrétních souvislostí mezi vývojem autorského práva a fotografie jak ve světě, tak i na našem území. V současné době fotografie zasahují do většiny oborů lidské činnosti a právě historický pohled na tento vývoj a samotné počátky formování jejich ochrany je nezbytný pro úplné pochopení soudobé právní úpravy a současného stavu a směřování fotografie. Důležitou součástí této práce jsou proto také významné historické soudní spory, které byly zásadní v boji za legitimizaci fotografie jakožto uměleckého díla, uznání statutu fotografa jakožto autora a pro zahrnutí fotografie mezi umělecká díla chráněná zákonem. |
| Translation of abstract | This work is concerned with the historical development of copyright issues in the field of photography since 1948. Its goal is to search for concrete connections in the development of photographic copyrights worldwide, and in the local Czech context. Currently, photography touches all aspects of human activity, and because of the this, a historical analysis of this development of protection is necessary to completely understand photography?s current, contemporary position and direction. For this reason, several historical court cases have been included, which have been key in the fight to legitimize photography as an art, and crucial in giving legal recognition to the photographer as an author of a work, protected by law. |
