| Abstract | Tato práce se zabývá tématem pracovních smluv s výkonnými umělci v divadle napříč soubory baletu, činohry a opery. Zaměřuje se zejména na otázku uzavírání pracovního poměru na dobu určitou nebo neurčitou. V práci je popsána zákonná úprava této problematiky podle zákoníku práce. Po ní následuje část rozebírající různé aspekty zaměstnávání výkonného umělce v pracovním poměru, včetně aplikovatelnosti legislativy v praxi a možných dopadů pracovního poměru na dobu určitou nebo neurčitou. Hlavní část práce je rozdělena podle jednotlivých žánrů (balet, činohra, opera). Poukazuje na konkrétní specifika těchto oborů a věnuje se analýze současných postupů a jejich dopadů při uzavírání pracovních smluv s výkonnými umělci v konkrétních českých divadlech na základě provedeného výzkumu. Ten se opírá o interní předpisy divadel, rozhovory a emailovou korespondenci se zaměstnanci jednotlivých divadel. Cílem této práce je nejen popsat současný stav praxe uzavírání pracovních smluv s výkonnými umělci, ale také navrhnout optimální řešení s ohledem na specifika jednotlivých oborů a na potřeby zaměstnavatele i zaměstnance. |
| Translation of abstract | This thesis deals with the topic of employment contracts with performing artrists in a theatre across ensembles of ballet, drama and opera. In particular, it focuses on the issue of fixed-term or indefinite employment closures. The thesis describes the legal arrangements for this issue in compliance with the Labour Code. This is followed by a section discussing the various aspects of employment of a performer in employment, including the applicability of legislation in practice and the potential effects of a fixed-term or indefinite employment relationship. The main part of the thesis is divided by genre (ballet, drama, and opera). It points to specific specifics of these professions and is dedicated to analysing current practices and their impacts in the conclusion of employment contracts with the performers in the specific Czech theatres based on research carried out. This relies on internal theatre regulations, interviews and email correspondence with the employees of individual theatres. The aim of this thesis is not only to describe the current state of practice of entering into employment contracts with performers, but also to propose optimal solutions with regard to the specifics of individual disciplines and the needs of both employer and employee. |
