| Abstract | Práce se zabývá právními situacemi, které mohou nastat při vývoji literárního scénáře. První část rozebírá jednotlivé možnosti vykoupení licencí ke scénářům hotovým, rozepsaným nebo těm, co jsou psané na objednávku. Celá práce je psaná především z pohledu producenta, ovšem závěr první části se věnuje také ochraně práv scénáristy. Druhá část popisuje další autory, kteří se mohou podílet na vývoji literárního scénáře, a se kterými je tudíž nutné uzavřít licenční smlouvy. Zabývá se také specifiky filmové adaptace a autorského překladu. Ve třetí části je popsáno problematické postavení námětu v českém právu a jsou zde uvedeny některé možnosti jeho ochrany, stejně tak jako možnosti ochrany koncepce televizního pořadu nebo seriálu. Poslední část upozorňuje na možné důsledky nedostatečného vyřešení autorských práv. Rozebírá také možné vědomé i nevědomé zásahy scénáře do ochrany osobnosti některých osob a jejich právní důsledky. |
| Translation of abstract | The aim of the thesis is to analyse legal situations, which may arise during the creation of a script. The first part is concerned with the particular possibilities of buying out licences to finished scripts, as well as to partly completed scripts and custom-made scripts. The viewpoint of the thesis is predominantly of a producer, however, the last chapter also includes the examination of the protection of rights of a scriptwriter. The focus of the second part is on further authors who can participate on the script development and with whom it is therefore necessary to conclude a licence contract. This part of the thesis is also concerned with the specifics of the film adaptation and the author?s translation. The third chapter describes the problematic position of the topic in the Czech law. It includes some of the possibilities of its protection as well as the protection of the conception of a television programme or a serial story. The final part refers to the possible consequences of the insufficient legal settlement of the copyright. It also elaborates the potential conscious and unconscious interventions of the script into the right of privacy and its legal consequences. |
